The U.S. Department of Labor issued General Decision Number MT 180080 for Highway Construction Projects effective March 2, 2018.  There are numerous increases to the various worker classification wage rates and fringes amounts.  The Federal Wage Rates found in Section II or III of the bid package proposal are hereby replaced with the attached:  FEDERAL WAGE RATES

Rock, soil and other debris excavated and disposed of will be measured at the disposal site(s). Provide the Project Manager a minimum three days’ notice to coordinate this work at each disposal site. The contractor is solely responsible for identifying and securing disposal sites.

Special Provision #22 – Work Site Safety – is hereby replaced with the following: 
22.    WORK SITE SAFETY
A.  General.Worksite safety is the responsibility of the Contractor.Perform all work in a manner that minimizes hazards and exposure to the public, construction personnel, and equipment in accordance with Section 107.
B.  Temporary Rockfall Protection.Install and maintain all temporary rockfall protection measures included in the accepted Temporary Rockfall Protection Work Plan at all times during the rockfall mitigation work and for the duration of the project.Do not perform any work on the slope without temporary rockfall protection measures in place.
C.  Emergency Access.Provide access for emergency vehicles throughout all active and inactive work zones for the duration of project in accordance with the Contract.
D.  Method of Measurement and Basis of Payment. Worksite safety is not measured or paid separately.  All costs associated with worksite safety, including necessary or additional sequencing, procedures, mechanisms, equipment, and labor are incidental to the project.

The following language is added to Special Provision #18 Traffic Control and Sequence of Operations B. Traffic Control. 
Periodic Traffic Stops.  I-15 traffic may be stopped in both directions for up to 20 minutes between the hours of 8 am and 4 pm, Monday thru Saturday.  Maintain minimum permissible two-way, two-lane traffic at all other times.  Allow queued traffic to pass through the site for up to 20 minutes. Stop traffic after the 20 minute interval or when the standing traffic queue has cleared.  Use flaggers or other standard traffic control devices (i.e. traffic lights) to conduct the periodic traffic stops.  Provide walk back flaggers to inform motorists of the stop condition and expected delay. Periodic traffic stops are for work that has the potential to produce rockfall that could bounce over, around or overwhelm the temporary rockfall protection.

Plan Sheet 10 has been revised.  The quantity (8,950.00 CUYD) of Excavation-Unclassified that was previously included in the Scaling Hours Summary Frame has been added to the Grading Summary and will be measured for payment.  An addendum will be issued to increase the quantity of Excavation-Unclassified to a total of 20,350.00 CUYD.  REVISED PLAN SHEET 10

It appears some small trees may need to be removed for excavation operations. Will MDT consider and earlier NTP date to solely allow time for tree removal prior to April 15th?

Remove trees positioned along the crest of the cut slope and having a portion of the root system exposed (root jacking) during scaling operations. Remove any remaining trees or shrubs within the rock scaling limits in accordance with Special Provision #17 - Migratory Bird Treaty Act Compliance-Vegetation Removal.

The following Special Provision is hereby added to the contract:
 
EXPEDITED NOTICE TO PROCEED [108]
This project will have an expedited Notice to Proceed. The awarded Contractor is required to submit the completed performance and material bonds, and insurance certificates five calendar days after the project is awarded, with the day after the award counting as the first day. The Notice to Proceed will be issued with an effective date of April 10, 2018 for purposes of vegetation removal.  Upon Project Manager approval of vegetation removal, contract time will be suspended until May 14, 2018.

Please clarify Special Provision No. 48 and No. 49. Will MDT Maintenance be removing and disposing the sanding material at all areas of remove and new guardrail?

MDT Maintenance will provide equipment and manpower necessary to remove and dispose of excess sanding materials during guardrail replacement. Coordinate with Kam Wrigg (406) 494-9627 and Mike Matthews (406) 444-6399 at least two weeks before guardrail work begins.

Per Special Provision No. 26 the contractor has to dispose 1,360 CUYD at Reference Post 146.4, this site has limited access and substantial longer haul than other available disposal sites. Is it required to dispose this material at this site?

Remove and dispose of all rock, soil, and other debris currently deposited at the toe of the cut slope as well as materials produced during scaling operations.

Per Special Provision No. 31 the contractor has to dispose of millings not used in Plant Mix Surfacing, Traffic Gravel, Crushed Aggregate Course or Special Borrow at the specified MDT Maintenance and Jefferson County Road Department locations. With other available disposal locations with better access and better truck hauls, which would allow for significant cost savings to MDT, would the contractor be allowed to dispose of millings at locations of their choice?

If high winds and severe weather are encountered during project work dates, leaving the RCN nets up after work hours could be hazardous. The past Project that our company scaled in Montana this was not a requirement for project, do to high winds. Even with concrete blocks securing RCN they still would move back and forth from inside paint line to MRB often times getting hung up. Would the contractor be able to drop the nets during non working hours if the scaled areas present no risk to traveling public?

Can a contractor drop the RCN Nets during the scaling of upper benches and Traffic stops?  Scaling from that height puts the Crane in danger of being hit because the rocks get re-routed many times from bench to bench.

We foresee 10-15 days to build and modify crossovers and then 80 days to scale and complete bridges, excavation, etc on south bound side while traffic is detoured to North bound side. Once this work is complete, milling and paving both north and south bound sides is estimated to be 15 days, plus 15-20 days for guardrail and other misc. work; and then remaining bridge work on north bound lanes is estimated to be another 50 days. Then remaining seal and cover, epoxy, etc is at least another 10 days. Please add 80 days of contract time.

If RCN have to be up during non working hours the Crane companies are saying they will need a operator with the Cranes during non working hours in case of hazards. This could increase the cost road protection significantly. Can you please state if this will be a requirement?

RCN are not required to be in place during non- working hours.  Special Provision #24 Scaling is revised accordingly.

Sheet B4 of the plans show the hydro overlay extending to the face of barrier. Will MDT allow a 10 inch offset from the barrier to allow for screed pipe placement? Allowing the offset will result in cost savings to the Department and a safe application.

Due to the rock scaling and bridge work on this project we have some concerns with Special Provision #18 (Traffic Control and Sequence of Operations) along with the 120 days of contract time. The phasing requires that traffic is to be crossed over to the northbound lanes and all work including rock scaling, bridgework, milling and asphalt paving is to be completed in the closed southbound lanes. Traffic is then to be switched so the contractor can perform the bridgework, milling and asphalt paving on the northbound lanes. The rock scaling bid item is set up for 4,060 hours which could take anywhere from 3 to 5 months depending on the number of scalers working the slope. The time frame to complete the rock scaling will dictate the sequencing of all other major items of work under this phasing requirement. We ask that the phasing be changed to allow that once the bridgework and quardrail work is completed on the southbound lanes it can be switched between the median barrier crossover at mile post 159.14 to the median crossover at mile post 163.57 to allow the same work to be completed on the northbound lanes while the rock scaling continues on the south end of the project in the southbound lanes. The polymer overlay, remaining guardrail work, milling, asphalt paving and chip seal can then be completed under lane closures once the rock scaling is complete. We also request that an additional 60 days of contract time be added to this project.

Since the Scaling bid item requires a Pre-Qualified Rock Slope Stabilization Contractor will MDT consider this a specialty item as per Section 108.01.2 of the Standard Specifications?

Can MDT clarify if a culvert will be required for the Crossover-Const, Maintain, Close bid item?  If one is required please specify the diameter and length.

An estimated 24" x 450' drain will be required for the permanent cross-over.
