How far outside of the MDT ROW will the contractor be able to work?

MDT has not secured any temporary construction permits and therefore the Contractor will not be allowed to work outside of MDT ROW without written permission from adjacent landowners secured through the Contractor.
The existing access control fence is not representative of the ROW limits along the entire project limits, specifically near the existing culvert inlet and outlet, refer to the linked set of as-built/ROW plans for ROW limits (sheet 25/26), these ROW plans are included for information only. Work outside of the Access Control fence is expected but work must be in accordance with the contract and associated permits both obtained by MDT and the Contractor.

1) What are the limits of the current permits in place for this project?
2) Specifically what permits is the Contractor required to obtain that the MDOT does not have in place as of today?
3) If there are permits not in place by the MDOT, there could be substantial delays in approval of these permits by the Government Agencies. If applications are submitted and approvals are not given by the Government agencies, will Time be added to the Contract until the permits are approved?

1) Refer to the contract special provisions and clarification #6 for information regarding the permits MDT has already obtained from the Corps of Engineers and FWP. MDT has obtained permits for permanent facilities only.
2) Obtain a temporary facility SPA 124 Permit/Authorization, a DEQ 318 authorization, a CWA 404 Nationwide Permit 33, and transfer MDT's current storm water discharge permit under MPDES to the Contractor. The MDT-R3-41-2018 preconstruction authorization does not cover the construction of temporary facilities such as work bridges, work pads, cofferdams, temporary detours, diversion, etc. This authorization does not include the removal and disposal of the existing structure, access to and from authorized locations, sequencing and construction methodology to construct authorized features, or any other unauthorized impacts affecting permitted drainages. These items, and any other items not covered here but potentially affecting a stream/river or its channels(s), need to be permitted separately by the Contractor. These requirements herein do not supersede requirements laid out in Subsection 107.11, Section 208 or other requirements in the special provisions. Additionally the list of permits indicated is not all inclusive, as Contractor equipment, means and methods, access, etc. are the responsibility of the Contractor to permit.
3) MDT project coordination with the Resource Agencies has informed them of the tight time frames. The agencies have committed to an expedited review and permitting of temporary facilities. However, this time frame is based in part on the completeness of the application submitted by the Contractor. Contract time is administered in accordance with Subsection 108.07.
