We have mentioned the issue of contract time several times recently, and this project appears to require that permits for temporary facilities be obtained. It is unlikely these permits can be developed, reviewed, and obtained within the 10 days between the award date and the current notice to proceed date. Our folks think a more realistic time frame to obtain these permits would be 30-45 days. Additionally 20 working days seems insufficient to sequence the work on this project. The project requires procurement and delivery of the box culvert, foundation/bedding material, rock fill, special backfill/crushed aggregate course, embankment material, and riprap. I'm told the procurement and delivery of all these items could take upwards of 20 days which would leave no time to complete the work on site. Will the DOT either add more contract time (35 days) or a flex date notice to proceed to allow for permits and material procurement prior to contract time starting?

This is an emergency project, and the intent is to get the project completed as soon as possible to minimize the risks to Secondary Highway 448 associated with potential runoff events. The accelerated Award and Notice To Proceed have been set to give the contractor the best opportunity to construct the project prior to winter shutdown. MDT has worked with the permitting agencies and we believe that with due diligence, it will be possible for the contractor to obtain the necessary permits prior to the Notice To Proceed. Per Standard Specification 108.02, "If work cannot begin on the date in the Notice to Proceed due to reasons beyond the Contractor’s control, these conditions, dates, and reasons will be recorded in the weekly Assessment of Contract Time report and no time will be charged."
The box culvert has been ordered and purchased by MDT and delivery to the project site is currently scheduled to begin September 17th. Rock material stockpiled at the MDT Owned Property is available to the contractor for use in the Special Embankment and Rip Rap Class 2 items. It will be up to the contractor to coordinate delivery, unloading, and staging of the box culvert as per the special provisions.
With this response, Special Provision #2 - Contract Time is hereby rescinded and replaced with the following Special Provision - Contract Time - Flex Time Proceed Date:
CONTRACT TIME – FLEX TIME PROCEED DATE [108] (REVISED 1-21-16)
A. General. This provision modifies Subsection 108.02 of the Specifications.
B. Notice to Proceed. The notice to proceed will be issued with an effective date of September 24, 2018. The Contractor may change the notice to proceed date to an earlier date if written notification is received at least ten calendar days in advance of the date selected and the selected date is approved by the Project Manager. Include an updated schedule with the notification.
C. Contract Time. Contract time assessment will begin on the notice to proceed date issued by the Department or as changed by the Contractor, whichever is earlier. Work is to be completed in 20 working days.

With regard to the question submitted by Cary Hegreberg at the Montana Contractors Association, the change to flex time most likely fixes the permitting timelines. However, it still doesn’t address the amount of work and the insufficient time provided to complete the project. Hauling and placing 2110 cy of 2 foot minus rock 35 feet over a steep embankment, excavating an approximately 32 foot cut in the road, placing the excavated material in a tight work area, with access difficulties from one side to the other once the excavation is started, placing 168 feet of box culvert that has to be delivered from Helena one piece at a time, with no room for staging of the 48,000lbs sections, (they will have to be hauled and placed as they arrive) and then filling in the 32 foot excavation with significant quantities of special backfill, embankment and CAC is not going to be able to be completed in 20 working days. Will the department please review the work required for this project and add 15 working days?

MDT has reviewed the work required for this project and believes sufficient time is provided. Work is to be completed in 20 workings days.
