The following special provision is hereby made a part of this contract:
SEQUENCE OF OPERATIONS
Construct and complete the 0.4' milling and 0.4' overlaying paving section between EB Sta. 1041+40 to 1052+70 prior to any other milling and paving operations.  Contractors can submit a written request to the Project Manager to allow milling and paving operations to take place outside of this special provision.

Can you clarify SP # 24/25?  Is it the intent to mill and pave back evenly every shift by 7am and thus not have any abrupt edges, joints or milled surface that are used by travelling public?  Can you clarify bid items 0030 and 01770 and the note on sheet sheet 11 under the summary table that states "this work may differ substantially and or be removed completely?" These seem like a very substantial amount of work, that may or may not be completed.  Also, if this work is to be completed, please adjust necessary traffic control restrictions, as it would be impossible to saw cut, remove, excavate, place non -frost susceptible backfill material and pour/cure concrete without a complete lane closure for many consecutive shifts.

Yes, the intent is to pave back evenly every shift to avoid abrupt edges, joints, or placing the traveling public on the milled surface. Special Provision 22 does not allow traffic to be on a milled surface. Please see Addendum 1, the work referenced in the second part of the question has been removed from the proposed contract.

For the safety of MDT and contractor personnel. Would the department consider using crossovers and put all public traffic to one side of the interstate while the work is being completed on the other side. Knife River sees this lane closure plan as a huge risk to the safety of personnel. This would completely change the lane closure plan but would enable the paving operations to be completed in a more timely manner.

MDT places the utmost importance to the safety of everyone including contractor personnel, MDT staff, and the traveling public in efforts achieve the goal of Vision Zero.  MDT has considered crossover staging on this project, but this section of I90 is not conducive to crossover's for many factors including the large amount of interchanges and high seasonal and daytime traffic volumes both of which present safety concerns as well.  MDT does consider staging proposals and would consider specific traffic device proposals to increase work zone safety, but at this time MDT will not consider alteration to the currently proposed traffic control staging to include the use of crossovers.

While PCCP work is being completed there will be roughly a 3’ cut. Does the department plan on using temporary barrier rail to protect the workers and public while this work is being completed? There isn’t a bid item for temporary barrier.

How does the department plan on handling the water that will be trapped in the "bird bath" milling area during a rain event. Will tack need to break in wet conditions before paving operations begin? Is it the departments intent to charge lane closure fees for these weather events that prohibit paving completion by 7:00 am?

It is the responsibility of the contractor to plan milling and paving operations to the requirements of special provision 24 and 25, taking into account weather events such as rain.  Yes, tack will need to break and otherwise be applied per section 407.

In the event of accidents and emergency vehicles that shut down traffic including contractor trucking is it the departments intent to charge lane closure fees for accidents prohibiting paving completion by 7:00 am?

It is the responsibility of the contractor to plan milling and paving operations including delivery of asphalt to the requirements of special provision 24 and 25, taking into account potential traffic backups and other issues.  In the event of a condition not caused by the contractors operations that would be unreasonable for the contractor to foresee, MDT will make a case by case determination on how to apply any potential Lane Closure Fees.

Bid line number 0170 PCCP Slab Replacement is difficult to estimate. The note in the plans states the quantity may change substantially or be removed completely. How do you give one price for a quantity that could be 3,121 sy or 10 sy? Would the department consider removing this bid item and change order it into the project when the quantity is known.

Does Standard Drawing 501-15, "PCCP Repair" apply to the PCCP replacement panels (Dowels, Tie-bars, Saw Joints)? due to the fact that these replacement panels will be overlaid with asphalt, what parts of the of the Standard Specifications, Section 501 apply to the PCCP replacement bid item?

There is a conflict in special provisions with substantial penalty consequences.  Special provisions 24 & 25 layout the permissible time of one 72-hour period to remove and install all the new barrier on this project.  Special provision 29 and the plans acknowledge the fact that there will need to be 2 special length pieces of precast barrier built to fit in the runs between bridges.  SP #29 goes on to require the contractor to submit 3 weeks in advance a design for approval prior to building the 2 special pieces.  Then the materials would need to be procured, the barrier poured, and wait the cure time until it reaches required strength.

The length of the two special pieces of barrier can not be determined prior to the remainder of the new barrier being installed. Regardless of the Department maintaining the 3-week submittal period, it is impossible to build, cure, and install the two special pieces within the 72-hour period allotted.  The process is at least 10 to 15 days out from when the remainder of the new barrier is set.  The penalty rate of $500 per 15 minutes would be substantial  waiting for the two custom pieces to be able to be set.

The contractor may submit a plan for approval on a temporary median barrier detail to be in place for a period of time while the transition is getting cast.
