A Special Provision titled Status of Utilities has been added to the contract; see clarification #2. Existing utility locations are shown in the plans; other utility plans are not available. Century Link, Northwestern Energy, Vigilante Electric, and Sprint have utilities located within the project limits. Sprint has completed their relocations while the remaining utilities are expected to begin relocation work in the late winter- early spring timeframe.

The preliminary plans showed 370 working days for contract time. When the advertised plans came out the contract time was reduced to 300 working days. After building a schedule for the project, it is apparent that the 370 working days will be required to construct the project without working double shifts and large amounts of overtime which will drive the project costs up. Please consider changing the contract time back to 370 working days.

The work begins on the effective date stated in the Notice to Proceed (NTP) and is to be completed in 350 Working Days. The NTP will be issued with an effective date of March 25, 2019. Sequence the work to allow traffic to be routed from the PTW to the new alignment no later than November 15, 2020. Complete work on all elements of the new bridges and roadway segment, excluding seal coat, final pavement markings, obliteration of PTW, seeding, and structure removal, before routing traffic onto the new alignment. The Project Manager has sole authority to determine when the new alignment may be opened to traffic. Failure to route traffic onto the newly completed alignment by November 15, 2020 will result in the department assessing contract time until traffic is routed onto the new alignment.

The seed mix is specified for revegetation of the project areas of disturbance. It is referencing the project specific seed blend for the project which includes flowering forbs. There is no activity allowed in the Activity Exclusion Area, therefore no revegetation is needed there.

1) The estimated volume of Special Borrow needed for the Embankment Foundation Prep is 1,430 cubic yards and is included in the 218,460 cubic yards total of Special Borrow – Neat Line in the Special Borrow Frame;
2) The estimated excavation volume for the embankment foundation preparation of 415 cubic yards ( and is included in the 175,182 cubic yards of Unclassified Excavation in the Grading Frame).
Please also reference the Embankment Foundation note on Cross Section Sheet #84 and applicable Cross Sections on Sheets 85-88.

Special provision 24: 404 permit states: remove 5 piers to 3 feet below lowest channel elevation of the stream. Special provision 27: Stream Protection act, Item 6 says: Remove existing piers/footings - - to at least 3 feet (915 mm) below the existing (lowest channel bottom elevation) of the stream, or completely. Special provision 36; Remove and dispose of the entire existing structures including but not limited to the - - piers, end bents, foundations. Do the entire pier foundation need to be removed?

No; piers/foundations or other substructures do not have to be removed completely. Remove these features at a minimum as stated in Special Provision #27 Stream Protection Act 124 B. General Conditions 6).

There is EXTREMELY LIMITED access for the work between the new bridges:
1) It appears MDT has not acquired any easements or ROW from MRL for access and construction - only final configuration. Please confirm Contractors are responsible for obtaining and paying for a) all track grade crossings, b) any access/haul roads on MRL property, c) any staging/storage areas on MRL property.
2) Using MRL grade crossings as haul roads - constant truck traffic will likely require track maintenance to maintain alignment and grades - will Contractors be responsible for these maintenance costs (work will be performed by MRL)?
3) Will MDT participate in any costs associated with MRL land usage? Single track at-grade crossing $6,500, staging/storage areas $0.11/square foot/year, access roadway lease $0.10/square foot/year?
4) Exhibit "C" 1.01.07 requires a baseline track survey and monitoring (interval unknown). Will this be performed by MDT?

Previous Question #29:
1) It appears that the pedestrian tunnel will need some kind of lane-separation (old from new) shoring to be able to complete. Is this cost to be included in the temporary shoring bid item?
2) MDT's answer to complete the entire pedestrian tunnel before swapping traffic is not possible to construct - Stage 1 needs to be complete with traffic put on to the new alignment prior to any work being done under the existing road - Stage 2. There is no other place for traffic to go unless all traffic is routed over the old bridge and through the town of Toston via the by-pass. It would appear Stage 2 work needs to be allowed to be performed after 11-15-20 or whenever traffic is on the new alignment. Please re-consider your response.

1) It is acceptable to install the portion of the pedestrian tunnel beneath the new roadway alignment stopping short of the PTW and at a point where shoring or other temporary means to support the PTW is not required. Construct the new roadway alignment at the tunnel crossing location to accommodate a minimum 12 foot wide lane in both directions of travel. Submit a work sequence and traffic control plan to the Project Manager for review and approval prior to beginning work on the pedestrian tunnel.
2) The entire pedestrian tunnel does not need to be installed before transferring traffic to the new roadway alignment.

1) Railroad Specials, Paragraph 1.03.08 indicate the State has not provided for staging areas, storage areas, access routes, temporary track grade crossings, or other Contractor uses of Railway’s property outside of those shown within established agreement areas on the Project plans. Are contractors required to carry the cost for this additional ROW within their bids or will MDT carry such costs?
2) Additionally, Railroad Specials, Exhibit E (Railroad Construction Requirements), Paragraph F, limit track windows to four-hour durations and to a maximum of five windows within any two week period. Given the uncertainty on obtaining additional real estate as indicated above, the amount of work required to construct a new bridge, remove the existing bridge, and average train traffic of 27 trains per day, these restrictions will significantly limit contractor’s ability to perform the work in a cost effective manner. Is there an opportunity for MDT to negotiate longer track windows with MRL?
