C.1.a of the MOU states "For any project that MDT is constructing on the Reservation, MDT and the Tribes will consult to identify and select the source and location for temporary withdrawal of water for construction puposes." Is there a water source available and what is the location of this source? Submitted Thu, 16-Jul-2015 08:15 MDT MDT did not establish any water sources with the Tribes. According to the PSA for this project, "Water to be used by the contractor for the Project may be obtained by the prime contractor from any lawful source desired by it. There will be no Tribal charges to the contractor for Project water unless the prime contractor negotiates and obtains water from a tribally-owned source." |

The MOU Part G.2.Tero Fee: states "For projects that are located only parly on the Reservation, the TERO fee assessment will be pro-rated to be equivalent to the ratio of miles of project within the Reservation to total miles of the project." Can MDT provide a percentage of the total contract amount that the TERO Fee will be applied too? 2. The PSA Part D. states "An Indian Preference Contracting Fee ("IPC fee") of three percent (3.0%) will be assessed against the total contract cost." Is the IPC Fee the same as the TERO fee? or is this an additional fee? Is the IPC Fee charged on the total contract or a percentage as stated in the MOU? 3. Additionally there is no mention of an Improvement of Services (IOS)fee in the PSA. Is there no required IOS fee on this project? Submitted: Tuesday, 21-JUL-2015 12:45 PM 1. The TERO Fee will be prorated based on 54.14% of the total project located on the reservation. 2. The IPC fee is the same as TERO. The IPC fee is based on the percentage of the contract located on the reservation. 3. There is not an IOS fee on this contract. |
